These Terms of Service ("Terms") govern your use of the 5G Construction website, forms, communications, estimate requests, and related services.
For purposes of these Terms, "5G Construction," "Company," "we," "our," or "us" refers to the construction division, brand, or trade name operated by 5G Security LLC.
By using our website, submitting a form, requesting an estimate, communicating with us, or engaging our services, you agree to these Terms.
5G Construction may provide or coordinate services including but not limited to: roofing repairs and replacements, patio construction and repairs, make-ready and turnover work, general repairs and handyman services, interior work including drywall, painting, and carpentry, exterior work including fencing, gutters, and leak repairs, and related construction support services. The specific scope of work, pricing, timeline, materials, exclusions, warranties, and payment terms for any project must be confirmed in a written estimate, proposal, work order, agreement, or contract.
Information on our website is provided for general informational and marketing purposes only. Website content does not create a binding offer, contract, warranty, or guarantee. Service availability, pricing, timelines, and project feasibility may vary based on location, property conditions, labor availability, material availability, permitting requirements, subcontractor availability, and other factors.
Any estimate, quote, or proposal we provide is based on the information available at the time it is prepared. Estimates may change due to hidden conditions, site access issues, code or permitting requirements, material price changes, labor availability, customer-requested changes, scope changes, discovery of additional work needed, third-party vendor or subcontractor pricing, or delays outside our control. No work is guaranteed until a written agreement is approved by the appropriate parties.
You agree to provide accurate and complete information when requesting services or communicating with us. You may be responsible for providing access to the property, ensuring you have authority to request work, providing accurate project details, disclosing known property issues, obtaining approvals from property owners, landlords, HOAs, tenants, or other required parties, reviewing and approving estimates, proposals, plans, selections, or change orders, making timely payments, and communicating changes or concerns promptly. We are not responsible for delays, added costs, or issues caused by inaccurate, incomplete, or withheld information.
Depending on the project, work may be performed or supported by employees, contractors, subcontractors, vendors, suppliers, or third-party service providers. We may share project-related information with these parties as needed to evaluate, estimate, schedule, perform, or complete work.
Some projects may require permits, inspections, code compliance, engineering, architectural plans, or approvals from local authorities. Unless specifically stated in a written agreement, responsibility for permits, approvals, engineering, architectural services, inspection fees, utility coordination, and related requirements will be determined on a project-by-project basis.
Payment terms will be stated in the applicable estimate, invoice, proposal, work order, or contract. Unless otherwise agreed in writing: payments are due according to the invoice or agreement provided, deposits may be required before scheduling or starting work, late payments may delay work or project completion, unpaid balances may be subject to collection activity where permitted by law, and customer-requested changes may require additional approval and payment.
Changes to the approved scope of work may require a written change order, revised estimate, or additional approval. Change orders may affect pricing, materials, labor, timeline, scheduling, completion date, and project scope. We are not obligated to perform work outside the approved scope unless agreed in writing.
Project schedules are estimates only unless specifically guaranteed in writing. Delays may occur due to weather, material delays, labor availability, subcontractor availability, permitting or inspection delays, customer delays, site access issues, hidden conditions, safety concerns, emergencies, or events outside our control. We are not liable for delays caused by factors beyond our reasonable control.
We may take photos, videos, notes, measurements, or other documentation of project sites for estimating, planning, quality control, recordkeeping, marketing, or dispute-resolution purposes. We will not intentionally disclose sensitive personal information in public marketing materials. If you do not want project photos used for marketing, you must notify us in writing.
By submitting your contact information, you agree that we may contact you by phone, text message, email, voicemail, or similar methods regarding your inquiry, estimate, appointment, project, or related services. Message and data rates may apply. You may opt out of marketing text messages by replying "STOP" when applicable. Service-related communications may still be sent when necessary.
We may use CRM systems, automation tools, communication platforms, analytics tools, and artificial intelligence-assisted tools to help manage inquiries, customer records, follow-ups, scheduling, lead tracking, project notes, and internal workflows. AI-assisted tools may help summarize information, draft responses, organize project details, or improve internal efficiency. AI-generated or AI-assisted content does not replace professional review, final estimates, written contracts, or project approvals. You agree that information you submit may be processed through these systems as part of our normal business operations.
Website content, emails, text messages, or informal communications are not legal, engineering, architectural, safety, insurance, or financial advice. You should consult qualified professionals where required for legal, engineering, architectural, insurance, safety, financial, or code-specific matters.
Any warranties related to labor, materials, products, or workmanship must be stated in a written agreement, invoice, manufacturer warranty, or project-specific document. Except as expressly stated in writing, our website and services are provided without warranties of any kind, whether express or implied, to the fullest extent permitted by law.
To the fullest extent permitted by law, 5G Construction and 5G Security LLC will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost business, loss of use, delays, or loss of data. Our total liability for any claim related to the website, communications, estimate, or services shall not exceed the amount paid by you to us for the specific service giving rise to the claim, unless otherwise required by law.
You agree to indemnify and hold harmless 5G Construction, 5G Security LLC, its owners, employees, contractors, subcontractors, vendors, agents, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from your use of the website, information you provide, your breach of these Terms, your failure to obtain required permissions or approvals, your misuse of our services, or claims by third parties related to your project or property.
Our website or communications may include links to third-party websites, tools, vendors, suppliers, financing providers, referral partners, or service providers. We are not responsible for third-party websites, services, pricing, policies, availability, actions, or content.
All website content, branding, logos, text, graphics, layouts, service descriptions, images, and other materials are owned by or licensed to us unless otherwise stated. You may not copy, reproduce, modify, distribute, or use our content for commercial purposes without written permission.
You agree not to use the website for unlawful purposes, submit false or misleading information, attempt to interfere with website security, scrape or misuse website content, upload malicious code or harmful files, impersonate another person or business, or use our forms or systems to send spam or abusive messages.
We reserve the right to refuse service, decline a project, cancel an estimate request, terminate communications, or restrict website access where permitted by law, including where there is abuse, nonpayment, safety concerns, misrepresentation, conflict of interest, or a project is outside our service scope.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any disputes shall be handled in the courts located in Lubbock County, Texas, unless another venue is required by law or agreed to in writing.
We may update these Terms from time to time. Updates will be posted on this page with a revised "Last Updated" date. Continued use of our website, forms, communications, or services after changes are posted means you accept the updated Terms.
